Briarcliff Manor Police Sergeant Faces DWI Charge [Updated]

A Briarcliff Manor Police sergeant is on voluntarily medical leave as he awaits the outcome of a DWI charge.

Yorktown Police Chief Daniel McMahon reported the department received a call on Dec. 3, 2011 at approximately 9 p.m. about an erratic driver on Route 202 near Stony Street. An officer stopped the vehicle and an investigation revealed the driver was allegedly drunk.

Sgt. Dominick Bueti was taken into custody for a DWI and transported back to the police department. As a result of a medical condition, Bueti was taken to an area hospital and formally booked about three weeks later, McMahon said. The defendant was photographed and his fingerprints were taken when appeared in court on January 3.

In the interim, Briarcliff Manor Village Manager Philip Zegarelli stated, "He is on voluntary medical leave. It is coming out of his own sick time."

Information about arrests is routinely publicized by the Yorktown Police Department on its website and through press releases, but this particular arrest was not made public until recently.

"There is no legal requirement for us to issue press releases, but we do it as a courtesy," McMahon said. "We're looking into why a press release was not faxed to the media [in this case] and we don't have an answer to that yet."

Press releases do not contain information about where a defendant works. McMahon said he does not want to speculate why the press release about Bueti's arrest did not go out, but said the department is investigating it.

According to a report on LoHud.com, Bueti, 44, is a resident of Cortlandt and has been a member of the Briarcliff Manor police force since 1992.

McMahon added there was no cover up at the Yorktown Police Department because that would mean there was something they did not do.

"The officers did their job, they stopped the individual, determined there was a probable cause to arrest him and they arrested him," he stated.

Said Zegarelli, "Charges are under review and the situation is under investigation. The Chief [Norman Campion] and I have 90 days from the incident—which was December 3—to recommend or not charges to the board."

After that recommendation is made, the village board of trustees will "sit as the board of police commissioners" to make a decision.

"I will have a recommendation to the mayor and board shortly," said Zegarelli. "In the meantime, he is utilizing his sick time to decide what he wants to do."

Bueti is due back in Yorktown Town Court today at 6 p.m.
