Pleasantville Court: Potential Extradition in Grand Larceny Case; Hearing Set for Alleged Teen Mugger
All defendants are presumed innocent until proven guilty. All ages represent the date of arrest.
Here's a look at what happened during Pleasantville Court's February 7 session. Criminal Court is in session every other Tuesday at 6 p.m.
Possible Extradition for Grand Larceny Defendant
James Francis Corey of Pleasantville appeared in court to answer to a charge of Grand Larceny in the Third Degree.
Corey, 46, remains in custody at the Westchester County jail on $2,500 bail for this charge.
He was arrested on January 27 after police investigated a larceny complaint involving the sale of a guitar in the village.
Corey is accused of taking $5,000 for the sale of a guitar without the seller's permission.
On Tuesday, a defense representative from the Legal Aid Society stated she had contacted the court about Corey's possible extradition to Utah, where he is allegedly a fugitive.
There is no bail set in the Utah matter.
The court set a March control date for the Pleasantville case.
Related Counterfeiting Cases Adjourned
Donna Jensen, 40, of Thornwood was charged with Possession of a Forged Instrument in the First Degree following a January 4 arrest. She is alleged to have attempted to use a counterfeit $20 bill at a village business.
Steven Gallo of Mount Kisco faces the same charge, as well as Possession of a Forgery Device. Gallo, 53, was arrested on January 3. He is accused of counterfeiting U.S. currency in the village.
Assistant District Attorney Nicholas DiCostanza said the matters were "companion case[s]" and said he would have an offer at the next court date.
The cases were then adjourned until April 3.
Grand Larceny Defendant Arraigned
Nicholas Lopez of Mount Kisco appeared in court to answer to a charge of Grand Larceny in the Fourth Degree.
Lopez, 20, allegedly deposited checks worth more than $1,000 into his bank account from his employer, a Pleasantville restaurant, after previously depositing the same payroll checks.
On Tuesday, Lopez's attorney entered a plea of not guilty on his behalf and requested an adjournment.
The case was adjourned until April 3 and Lopez's bails status ($100) continues.
DWI Defendant Pleads Guilty to Violation
Catherine DeLoughry of Pleasantville pled guilty yesterday to Driving While Ability Impaired, a violation.
The 48-year-old was originally charged with Driving While Intoxicated following a Dec. 21, 2011 arrest.
DeLoughry was sentenced to a one-year conditional discharge and $560 in fines and surcharges. She is additionally required to complete Mothers Against Drunk Driving (MADD) and Drinking Driving Program (DDP). She was also issued a 90-day license revocation.
Felony Hearing Set for Teen Defendant
Patrick Hopkins-Drago, 18, is charged with Robbery in the Second Degree, Assault in the Second Degree and Criminal Possession of Stolen Property in the Fifth Degree.
The Pleasantville man was arrested on July 6, 2011 in connection with these charges after he allegedly mugged a 12-year-old minor.
He was again arrested on Dec. 30, 2011 and charged with Criminal Possession of Stolen Property in the Fourth Degree and Petit Larceny.
He remains in custody.
On Tuesday, Hopkins-Drago's attorney stated she believes the complainant in the December case wishes to drop the charges.
DiCostanza noted the first arrest's case had been "pending for some time" and said he felt a felony hearing should be scheduled.
All parties agreed the hearing will take place on Monday, Feb. 13 at 9 a.m.
