Driver Charged with Manslaughter After Mangialardi's Death

The woman police say struck Mangialardi as he was crossing Route 9A faces a felony manslaughter charge.

The driver whose vehicle struck and killed Briarcliff Manor attorney John Mangliardi Tuesday night now faces a felony charge of Vehicular Manslaughter in the Second Degree.

Michelle Sergio, 38, of Nanuet, was initially charged with Driving While Intoxicated following the September 3 accident.


According to a statement from Westchester County Police, Sergio was arraigned on that charge in the Town of Ossining Wednesday morning. Her case, at the request of Ossining's court, has since been transferred to the Town of Yorktown, police said.

She is expected to be arraigned on the manslaughter felony charge—which was filed today—at her next scheduled court date, Tuesday, Sept. 10 at 6 p.m.

Police said, "Mangialardi was crossing Route 9A about 10:15 p.m. when he was struck in the northbound lanes by a  Nissan Altima driven by Sergio."

The accident occurred at the intersection of Route 134 in Ossining. Sergio was taken into custody after police said she failed a field sobriety test.

A blood sample taken later showed her blood alcohol content exceeded the .08 percent threshold for DWI.

"Also yesterday, at a hearing in Westchester County Court, Sergio’s bail was reduced to $125,000 cash or $250,000 bond," police said today. "Following her arrest on Tuesday, bail had been set at $250,000 cash or $500,000 bond."

Briarcliff Manor resident and Town of Ossining justice candidate Mangliardi, 55, was remembered by his colleagues and friends as a "gentleman."
