Federal Charges Filed in Pleasantville Skimming Case

The former Don Juan Mexican Restaurant waiter accused of stealing customers' credit card information remains incarcerated.

The former Don Juan Mexican Restaurant waiter accused of stealing more than $180,000 in funds from customers using their credit card information is facing federal charges, Westchester County Assistant District Attorney Virginia Marciano said Tuesday.

Gerardo J. Vera, a 42-year-old Bronx resident, appeared in Village Court June 25 to answer to a felony Criminal Possession of a Forgery Device charge.

He has been incarcerated in Westchester County Jail since April 30 arrest.

Marciano told the court federal charges against Vera have already been filed and she expected he would be arraigned shortly thereafter.

The Pleasantville charge is expected to be withdrawn at that time.

The village matter was adjourned to July 9, though Vera and his attorney will not have to appear if he is arraigned in federal court before that date.

Note: Arrests do not indicate convictions.
